¿Podría surgir la exigencia de la ley penal, que regula el comportamiento de las personas para mantener una sana convivencia y un orden social justo?

La terrible realidad nos alcanzó: la salud personal y la salud pública están hoy en grave peligro, los riegos están por todas partes. El coronavirus causante del COVID-19 es una “pandemia”. La Organización Mundial de la Salud (OMS) considera que los niveles de propagación e infección del virus en estos momentos son “alarmantes”, afirma el director general del organismo, Tedros Adhanom Ghebreyesus. Esta pandemia no es sólo una severa crisis de salud pública, sino que también afecta a todos los demás sectores, por lo que todos los gobiernos, sin excepción, y sociedades deben involucrarse en la lucha.

La OMS sigue defendiendo que “el virus causante de la Covid-19 se transmite principalmente por contacto con gotículas respiratorias, más que por el aire”. Estas gotas, lanzadas por una persona infectada al toser, al respirar o al hablar, aterrizan rápidamente sobre los objetos del entorno, donde son recogidas con las manos por otras personas, que se contagian al tocarse los ojos, la nariz o la boca. Ese mecanismo y la posibilidad de inhalar al vuelo una gota recién lanzada justifican las principales recomendaciones sanitarias: lavarse las manos frecuentemente, toser en el codo, no tocarse la cara y mantenerse a una distancia de entre 1 y 2 metros de otras personas. La transmisión aérea podría ser más habitual en los hospitales, durante algunos procedimientos médicos con los enfermos.

Sin embargo, el debate entre médicos y expertos continúa sobre su contenido, alcances y efectos nocivos e infecciosos, y piden cautela al momento de interpretar el tiempo que puede ‘estar’ el nuevo coronavirus suspendido en el aire. Incluso, aunque el nuevo coronavirus se ha detectado en heces de personas infectadas, nadie asegura por ahora que la contaminación fecal esté siendo una vía relevante de propagación.Equipos científicos se esfuerzan para comprender el virus a nivel molecular, esencial para desarrollar vacunas.

DELITO EN AGRAVIO DE LA SALUD

El Código Penal para la Ciudad de México describe en el artículo 159 el denominado “Delito de Peligro de Contagio”, de la siguiente manera: “Al que sabiendo que padece una enfermedad grave en período infectante, ponga en peligro de contagio la salud de otro, por relaciones sexuales u otro medio transmisible, siempre y cuando la víctima no tenga conocimiento de esa circunstancia, se le impondrán prisión de tres meses a tres años y de cincuenta a trescientos días multa. Si la enfermedad padecida fuera incurable, se impondrán prisión de tres meses a diez años y de quinientos a dos mil días multa. Este delito se perseguirá por querella de la víctima u ofendido”.

Esto implica que la ley penal establece a todas y cada una de las personas un ‘Deber Jurídico Penal’ definido como: la prohibición categórica a toda persona, que sabiendo que padece una enfermedad grave en período infectante (como es el coronavirus COVID-19), de ‘poner en peligro de contagio la salud de otra persona’, por relaciones sexuales “o cualquier otro medio transmisible”, siempre y cuando la víctima u ofendido no tenga conocimiento del peligro de contagio de dicha enfermedad infectante y transmisible.

Este delito protege un relevante y fundamental ‘Bien Jurídico’: “la salud” de la persona en peligro de contagio. Incluso, podríamos afirmar que, en el contexto de hoy, también protege “la salud pública”, sobre todo ante la declaración de pandemia a escala mundial o global.

Los virus son inquietantes porque no están vivos ni muertos. No están vivos porque no pueden reproducirse por sí mismos. No están muertos porque pueden entrar en nuestras células, secuestrar su maquinaria y replicarse. En eso son efectivos y sofisticados porque llevan millones de años desarrollando nuevas maneras de burlar a nuestro sistema inmune. Es una batalla que comenzó hace más de 3.500 millones de años con la aparición de las primeras formas de vida en la Tierra y que continúa ahora con la pandemia global de coronavirus (El PAÍS, Así infecta el coronavirus).

CONSIDERACIONES PENALES

Esta figura delictiva (Delito de Peligro de Contagio) seguramente será materia de debate y existirán discrepancias en cuanto a su posible comisión en el contexto de la actual pandemia. Sin embargo, bien vale la pena reflexionar sobre algunas consideraciones penales. Por ejemplo, el imputado o delincuente que ponga en peligro de contagio o, incluso, contagie el coronavirus COVID-19, debe tener la capacidad para comprender la ilicitud de su conducta, ya sea por la vía del ´dolo’ o la ‘culpa’; conceptos ambos que tienen una dimensión especial en el Derecho Penal, pues los delitos solo pueden ser cometidos a través de una conducta dolosa o culposa, respectivamente:

Se obra ‘dolosamente’ cuando el imputado (persona con enfermedad grave en período infectante) quiere o acepta la realización del peligro de contagio, o cuando, previendo como posible el peligro de contagio, quiere o acepta la afectación peligrosa a la salud de otro. En adición de que precisamente el enfermo debe saber que padece la enfermedad grave en período infectante.

Por otra parte, se obra ‘culposamente’, cuando el imputado (persona con enfermedad grave en período infectante) produce el peligro de contagio, que no previó siendo previsible por incumplir un deber de cuidado que le era necesario observar o, previó confiando en que no se produciría violando ese deber de cuidado que le era necesario observar. En estos casos de delitos culposos la pena disminuye pues se impondrá la cuarta parte de las penas del delito doloso.

El objeto material del delito consiste en la propia persona de la víctima, sobre quien recae, se realiza o se produce el resultado del “peligro de contagio” o el contagio mismo. Así, para la consumación del delito no se exige, necesaria ni efectivamente, que se produzca el contagio, pues ‘basta que se actualice el simple peligro del contagio’. Es decir, se sancionará penalmente la puesta en peligro de la salud de la otra persona (víctima u ofendido), con independencia de que se haya producido el contagio, Pero en caso de actualizarse seguramente agravará la pena y la reparación del daño.

Es importante considerar que ‘el medio’ para la consumación del delito puede ser por relaciones sexuales y “por cualquier otro medio transmisible”, como besos, abrazos, estornudos, toser de cara a la víctima, acercarse demasiado, platicar frente a la víctima u ofendido, no mantener la distancia adecuada ni las medidas de seguridad sanitarias o de higiene personales, entre otros medios.

El delito exige como referencia temporal el que la enfermedad que se padece “sea grave y en período infectante”, situación que en caso de debate deberá ser esclarecida por los médicos infectólgos o especialistas en el procedimiento penal para determinar el padecimiento o gravedad infecciosa del coronavirus COVID-19.

Dicho delito también exige una importante referencia de ocasión para la consumación del delito, en el sentido de que solo podría sancionarse la conducta, siempre y cuando la víctima no tenga conocimiento del peligro de contagio. Pudiendo ser esta situación muy discutible y compleja de probar en cada caso concreto.

PRESCRIPCIÓN DEL DELITO

Salvo disposición en contrario, la pretensión punitiva que nazca del Delito de Peligro de Contagio, que sólo puede perseguirse por querella del ofendido, prescribirá en 1 año, contado desde el día en que quienes puedan formular la querella (víctimas), tengan conocimiento del delito y del delincuente imputado, y en 3 años fuera de esta circunstancia.

Con independencia del Derecho Penal, es momento de ser total y absolutamente consientes, a nivel personal, familiar, laboral, social y gubernamental, de la posibilidad de transmitir la infección del terrible coronavirus causante del COVID-19, la cual señalan los expertos es una enfermedad grave que puede infectarse por muchos medios transmisibles.
